GENERAL TERMS AND CONDITIONS OF SALE<\/strong><\/p>\n

PREMISES<\/strong><\/p>\n

These General Terms and Conditions of Sale (hereinafter, “General Terms”) govern, pursuant to Italian law under Legislative Decree 206\/2005 and subsequent amendments (hereinafter, “Consumer Code”), the distance selling of wines and oenological products intended for human consumption (hereinafter the Product or Products) as well as related and connected services using the web Portal known as https:\/\/shop.leonardobussoletti.it (hereinafter, the “Portal”).<\/p>\n

The seller of the Products and owner of the Portal is: Societ\u00e0 Agricola Bussoletti Leonardo s.s., with registered office at Strada delle Pretare, 62 \u2013 05035 Narni (TR), Tax Code\/VAT No. 01453230557 (hereinafter BUSSOLETTI).<\/p>\n

The person accessing the Portal to purchase Products (hereinafter “The Customer”) is required to:<\/p>\n

\u2013 provide certain personal information (e.g. name, surname, address and email), accepting the privacy policy present in the form;<\/p>\n

\u2013 carefully read these General Terms \u2013 which constitute a binding agreement \u2013 and which may be consulted at any time by the Customer.<\/p>\n

In the event that the person making purchases on the Portal requests the issuance of an invoice and is not in any case a “consumer or user” as defined in art. 3, paragraph 1, letter a), of the Consumer Code, the right of withdrawal referred to in art. 5.1 of these General Terms and, more generally, the provisions which pursuant to the Consumer Code apply exclusively to “consumers” shall not apply.<\/p>\n

By submitting the order from the Portal, which constitutes a contractual proposal, the Customer acknowledges and declares having reviewed all information provided during the purchase process and fully accepts these General Terms as well as the current Privacy Policies.<\/p>\n

The contract entered into between BUSSOLETTI and the Customer is concluded upon acceptance of the order by BUSSOLETTI. Such acceptance will be communicated to the Customer via an order confirmation email containing a reference to these General Terms, the order number, shipping and billing details, the list of Products ordered with their essential characteristics, the total price \u2013 including delivery costs \u2013 and the payment method used.<\/p>\n

The Customer must check the confirmation email and, if any errors are found in the order, will have a time limit of two days from receipt of such email to contact BUSSOLETTI. After this period, the order will be processed for shipment.<\/p>\n

PRODUCT INFORMATION<\/strong><\/p>\n

Information and characteristics relating to the Products are available on the Portal. It is understood that the information on delivered Products may differ from that shown for reasons beyond BUSSOLETTI’s control (e.g. changes made to the Products), therefore it is always necessary to check the label and information shown on the delivered Product.<\/p>\n

BUSSOLETTI assumes no responsibility regarding information about Products provided by third parties.<\/p>\n

Product prices include all taxes and duties (VAT etc.). All prices are expressed in Euros.<\/p>\n

DELIVERY AND TRANSPORT<\/strong><\/p>\n

Products purchased on the Portal are delivered to the address indicated by the Customer during the purchase process. Products are shipped via home delivery or to a collection point if provided by the carrier. Once the Products have been shipped, the Customer will receive a shipping confirmation email.<\/p>\n

The carrier will contact the recipient to arrange delivery. If the recipient cannot be reached or is absent, the Products will be returned to BUSSOLETTI and the Customer will be charged the delivery costs and the cost of the Products.<\/p>\n

BUSSOLETTI reserves the right to cancel the order in the event of unforeseeable difficulties, informing the Customer by email, or, by agreement with the Customer, modifying the delivery date and\/or time.<\/p>\n

BUSSOLETTI shall not be liable for any delays occurring during transport that are not attributable to it.<\/p>\n

PAYMENT METHODS AND INVOICING<\/strong><\/p>\n

The Customer may pay the price of the Products and related delivery costs by bank transfer, credit\/debit card or PayPal.<\/p>\n

To ensure maximum transaction security, BUSSOLETTI does not store the Customer’s payment data.<\/p>\n

To ensure maximum security, the Customer will be redirected to the PayPal website where they can make payment in accordance with the methods accepted by PayPal and in compliance with its relevant terms.<\/p>\n

An invoice will be issued upon completion of the order process, by entering billing details including tax code and\/or VAT number, any company name and SDI Recipient Code. In this case, the invoice will be automatically sent to the Customer’s tax drawer, in accordance with applicable law. The Customer is responsible for the correct entry of billing data.<\/p>\n

RIGHT OF WITHDRAWAL<\/strong><\/p>\n

Cases of exclusion of the right of withdrawal<\/strong><\/p>\n

Pursuant to art. 59, paragraph 1, letters c), d), e) and f) of the Consumer Code, the right of withdrawal is excluded in the following cases:<\/p>\n

\u2013 Non-consumer Customer and\/or Customer requesting an invoice;<\/p>\n

\u2013 Products made to measure or clearly personalised;<\/p>\n

\u2013 Products that are liable to deteriorate or expire rapidly (e.g. food products and wines);<\/p>\n

\u2013 Products that are not suitable for return for hygiene reasons or related to health protection and which have been opened after delivery.<\/p>\n

In cases of exclusion of the right of withdrawal, BUSSOLETTI will return to the Customer the Products purchased and returned by the Customer, charging them the re-shipping costs, or dispose of them where necessary.<\/p>\n

Exercise of the right of withdrawal<\/strong><\/p>\n

The Customer may exercise the right of withdrawal, pursuant to art. 52 et seq. of the Consumer Code, in relation to Products other than those listed in the preceding paragraph, provided that after delivery they have not been opened or their seal altered.<\/p>\n

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.<\/p>\n

To exercise the right of withdrawal, the Customer must send BUSSOLETTI a written communication by email to info@leonardobussoletti.it with the subject “Exercise of the right of withdrawal” within 14 days of the delivery date of the Products, providing the following information:<\/p>\n

\u2013 order number and purchase date;<\/p>\n

\u2013 order delivery date;<\/p>\n

\u2013 Customer’s name and address;<\/p>\n

\u2013 Customer’s email and telephone contact details;<\/p>\n

\u2013 code of the item or items for which the right of withdrawal is to be exercised.<\/p>\n

The right of withdrawal applies to the Product purchased in its entirety: therefore, if the Product consists of multiple components or parts, the right of withdrawal cannot be exercised only on part of the purchased Product.<\/p>\n

In the event of exercise of the right of withdrawal, BUSSOLETTI will refund the Customer the full amount of the returned Products, within 14 days from the date on which the withdrawal notice was received, subject to BUSSOLETTI’s right to suspend the refund payment until actual receipt of the Products. The refund will be made using the same payment method used by the Customer.<\/p>\n

LABELLING AND MANDATORY INFORMATION<\/strong><\/p>\n

All wines sold on the Portal are labelled in compliance with EU Regulation 2021\/2117 and applicable regulations on wine and vine products.<\/p>\n

Each label features a QR code linking to a web page containing:<\/p>\n

\u2013 the complete list of ingredients and nutritional values pursuant to EU Reg. 1169\/2011;<\/p>\n

\u2013 instructions for the correct disposal of packaging (bottle, cork, capsule, box) pursuant to applicable waste regulations.<\/p>\n

Please note that wines may contain SULPHITES (sulphur dioxide and its salts). This information is shown on the label as an allergen pursuant to EU Reg. 1169\/2011. The Customer is required to check for the presence of allergens before purchasing, particularly in the case of known intolerances or allergies.<\/p>\n

WARNING: The sale of alcoholic beverages is prohibited to persons under 18 years of age pursuant to Law 189\/2012 and subsequent amendments. By placing an order on the Portal, the Customer declares under their own responsibility that they are of legal age (18 years or older).<\/strong><\/p>\n

COMPLAINTS<\/strong><\/p>\n

For any anomalies found on the Products, other than those due to the natural deterioration of food products or mere imperfection of packaging, the Customer may contact BUSSOLETTI at info@leonardobussoletti.it specifying the defects found and attaching photographic material.<\/p>\n

CONFORMITY DEFECTS<\/strong><\/p>\n

In the event of conformity defects in the purchased Products, the Customer must immediately contact BUSSOLETTI using the contact available on the Portal. The legal guarantees provided by articles 129 et seq. of the Consumer Code apply to the sale of Products. The Customer is entitled, at their choice and provided the type of Product allows it, to have the Product’s conformity restored free of charge by replacement, or to an adequate price reduction or contract termination.<\/p>\n

In the event of a defective Product, the Customer is asked to keep the bottle with at least 2\/3 of the original contents and with its original cork and to notify BUSSOLETTI of the alleged non-conformity. BUSSOLETTI will intervene as soon as possible by arranging a free collection in order to carry out a thorough inspection and propose the most appropriate solution.<\/p>\n

LIABILITY LIMITATIONS<\/strong><\/p>\n

Information relating to Products on the Portal is constantly updated. However, it is not possible to guarantee the complete absence of errors for which BUSSOLETTI cannot be held responsible, except in cases of wilful misconduct or gross negligence.<\/p>\n

BUSSOLETTI reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, or to modify or update information at any time without prior notice, subject to the Customer’s rights under these General Terms and the Consumer Code.<\/p>\n

Except in cases of wilful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of an indemnity, as well as any contractual or non-contractual liability for direct or indirect damages to persons and\/or property caused by the failure to accept or fulfil, even partially, an order, is excluded.<\/p>\n

PRIVACY POLICY<\/strong><\/p>\n

BUSSOLETTI will process the Customer’s personal data (Data Subject) in compliance with privacy regulations as detailed in the privacy policy (Privacy Policy), available in the relevant section of the Portal shop.leonardobussoletti.it.<\/p>\n

ONLINE DISPUTE RESOLUTION (ODR)<\/strong><\/p>\n

Pursuant to article 49, paragraph 1, of the Consumer Code, the Customer may avail themselves of the peer mediation procedure. The procedure may be initiated if the Customer, after having filed a complaint with BUSSOLETTI, has not received a response within 30 days or has received a response deemed unsatisfactory.<\/p>\n

The Customer who decides to use the Peer Mediation procedure is required to send the application to the following address: info@leonardobussoletti.it<\/p>\n

BUSSOLETTI also informs the Customer that pursuant to art. 14 of Regulation (EU) 524\/2013, in the event of a dispute they may submit a complaint via the European Union’s ODR platform accessible at the following link: https:\/\/ec.europa.eu\/consumers\/odr. The Customer may not in any case be deprived of the right to appeal to the competent court, regardless of the outcome of the out-of-court dispute resolution procedure.<\/p>\n

APPLICABLE LAW AND JURISDICTION<\/strong><\/p>\n

The sales contract between the Customer and BUSSOLETTI is concluded in Italy and is therefore governed by Italian Law. For the resolution of disputes relating to the interpretation, execution or termination of these General Terms, if the Customer is a consumer pursuant to the Consumer Code, the exclusive jurisdiction shall be the court of their municipality of residence or domicile, if located in Italian territory. In all other cases, exclusive territorial jurisdiction lies with the Court of Terni.<\/p>\n
